The21st century is the century of ocean. As the resource of the land have become less and less, people is now paying more and more attention on the ocean. The change from "backing the ocean" to "facing the ocean" has become a big trend in the ongoing world, which means the time of ocean have already arrived. Since the1980s in china, the exploitation of ocean resources have been rising every year. Because of people’s exorbitant exploitation in some zones of the ocean, there occurs a series of problems, such as the decay of partial fishery resources, the deficiency of the science authentication of making land from ocean, the rapidly decline of biologic diversity and the problem of the serious pollution of the ocean environment, making emergent necessity to establish environmental laws and rules, which can only be effective under the guidance of the Marxian biologic theory, because of which is systemic、harmonious、dialectic and us the materialistic, which also supply a general guidance and concrete route to establish environmental laws and rules.In this article, which adopts the combination of empirical and theoretical methods, is to understand the connotation of Marxist ecological theory, and the meaning、concept and characteristics of Marine resources. This article analyzes the problems in developing ocean resources and its root causes by comparing the various kinds of data. Finally, in order to provide legal issues on the Marine resources development and management of the opinions and Suggestions. This paper explores the legal regulating of the Marine resources development path under the guide of ecological theory of Marxist.To sum up, in order to seek the development of Marine resources legal governance path, this paper exporing the legal regulation under the ecological theory of Marxist. Only using the harmonious ecological Marxism ecological theory to guide the legal regulating of the Marine resources development, it is possible to realize the sustainable development of Marine resources.
