Labor dispatch is an innovative human resource service pattern, which can help the labor units with trans-regional, cross-industrial management of human resources according to the characteristics and needs of the industry. At present, labor dispatch business has gradually expanded from the developed areas of coastal line to the inland and underdeveloped provinces in the west, which is involved in the industries including construction, manufacturing as well as communications, tourism, transportation and so on. Accompanied by the growth of labor dispatch, a series of problems appeared: unclear operating status, mixed-business, the lack of protection for the interests of the three parties to the labor dispatch, the vicious competition between labor dispatch industries. The reason is mainly due to the imperfections of relevant laws, regulations, and policies, and the poor supervision of public administration departments, as well as some opportunistic enterprises and intermediary organizations driven by economic interests.Combined the dispatch status quo of the western developed countries with the situation of Fujian Province, the thesis expatiates the value original from the legislation philosophy and regulations of labor dispatch, the apportionment of responsibility between dispatch branches and labor units for Chinese labor dispatch system through literature, comparative research methods. Summary of gains and losses about foreign labor dispatch experience is to explore the improving way of Chinese labor dispatch as follows:to insist on equal pay system to protect the legitimate rights and interests of workers; and to confirm the apportionment of responsibility between dispatch agencies and labor units; also to control the scope of the labor dispatch; also to strictly prescribes the access regulations of dispatch agencies; meanwhile, to gradually prompt the socialized, institutionalized and professional development of labor dispatch under the constraints of the labor policies and laws.
