As a part of internet industry, the industry of search engine is one of emerging industries which arose in21st century. Search engine is the same as internet industry and has developed rapidly based on huge market demand. Due to the large scale of search engine, it has great effects on the development of social economy and people’s life. However, as same as the internet industry, all of the appearances of new industries will accompanied by a mass of disputes and obsessions. The reason why these obsessions and disputes emerge is not because of the disadvantage of search engine. The real reason is that social relations and interests should be rebuilt and adjusted when a new industry is emerging. In this circumstance, any help from department of legislation, judicature, administration and theory will greatly affect the speed, scale and direction of these emerging industries. Actually, hysteretic laws can not be adapted to suit the needs and requirements of emerging industries. Under this situation, we should urgently research and give our attention to emerging industries in aspects of both legal principles and practice.At present, only few of specific laws and regulations can stipulate the problems of search engine which arise from legal practice, even foreign practice of legislation and research of theory are not steady and ripe. Even if there has different levels of laws which can regulate the industry of search engine, these laws are principled and should be understood and applied combine with the specific situations of the industry. Therefore, this thesis is on the basis of comprehension of search engine and related technique questions and analysis of real cases, analyzes the reason of the disputes and actuality, investigates the development of internet industry represented by industry of search engine, in order to quest for basic route to right protection and development.This thesis puts disputes of Intellectual Property arise out of legal practice of search energy as object of investigation. The first part discusses and analyzes the problems appeared in service of search array and offers some views and suggestions; the second part primarily researches on downloading music in mp3format, and analyzes and understands some issues of technique and related articles of laws; the third part put wed snapshot as object of investigation, analyzes the disputes and studies measures:on the basis of above contents, the fourth part provides principles for solving legal disputes of search engine, offer the author’s suggestions for the development direction and route of internet industry represented by industry of search engine.
