Female is important member of human society, which determines that the culture of female is an important part of human culture. However, there are significant cultural differences in the female culture between the East and West, regions and ethnic groups, sometimes even diametrically opposite, which corresponds to the different opinions on the legal status of women, even more divergent. As the particularity of the Ming and Qing society, this paper try to sight the Ming and Qing fiction, through its legal status with the comparison between the Ming and Qing, Ming and Qing women’s family status of the analysis.As the novels and stories had been recycled and preserved by millions of people, we can consider the plot of any story, if there are still bound to the story because they belong to the whole cultural groups have a special meaning and value, rather than simply due to personal psychological factors. As a personal life experience of extraction and processing, the novels have been condensed into a symbolic form of existence of the system. On the one hand, we can acquire a lot of knowledge of jurisprudence; on the other good fiction would be a good alternative which the tradition of jurisprudence depends on, for further courses of contemporary jurisprudence provided by some comparative study of traditional topics and perspectives. As a result, it will provide some new areas at the same time. All history is contemporary history said by Mark Bloch "The unity of all the times is so close, the relationship between the two-way of ancient and modern. Distortion of reality must be from the ignorance of history; to face the reality. Without knowledge, to understand the history must have been in vain for people." The legal status of women in family during Ming and Qing’s Dynasties, depends on not only the reproducing and understanding of women in the family history of the Ming and Qing, with the interpretation of traditional Chinese culture with concerns of women, but also lies in the reconstruction of the personality of female civilization and positioning and reasoning.
