A Study On The Legal Status Of Women In Traditional Marriage And Family ——A Case Study Of The Qing Dynasty

Traditional Chinese marriage and family culture developed along with the development of the imperial system.Its ability to survive in the long river of history,in addition to its own characteristics,must also have its own existence value.Marriage and family are most in line with people’s real life,women play an important role in marriage,but also affect the rise and fall of a family.Before discussing the legal status of women in traditional marriage and family,we first thought about the meaning of traditional marriage and family.Taking this as a line of thought,the legal status of women in traditional marriage is discussed from the perspective of the conclusion of traditional marriage,the dissolution of traditional marriage and women’s right to remarry,and the legal status of women in traditional families is studied from the perspective of maternal rights,heir rights and property inheritance rights in traditional families.It is widely believed that women have a humble position in traditional marriage and family,and can even be directly described as "three-slave doctrine".However,in the actual life of ordinary people,women’s status in the traditional marriage and family,or legal rights,is not eclipsed.It is true that the laws since the Qin and Han Dynasties have indeed embodied to a considerable extent the attitude of comparing the affairs of "father and son and husband and wife" to the relationship between "kings and subjects",but the people have their most simple ideal pursuit of life,and the love between father and son and the love of husband and wife naturally have their sacred,fierce and unstoppable heavenly and human identity.Sorting out and distinguishing between the traditional marriage law culture,which is a reflection of real life and which are value-oriented,helps to further understand the status of women.Moreover,there are many organic factors in the traditional marriage and family culture,among which reasonable elements have a reference for building a modern harmonious marriage and family.It is worth pointing out that exploring the valuable points of traditional marriage and family culture is also a process of enhancing cultural self-confidence and national self-confidence.
