Opinions On Euthanasia Legislation

Euthanasia is an extremely complex issue, which is related to philosophy, medicine, law, religion, ethics, and involving the relationship of doctors, patients, families, and social. Thus there are still many disputes in academia. This thesis systematically discusses euthanasia issue in legal level, and puts forward feasible suggestions for euthanasia legislation under the existing conditions.First, this thesis starts from the definition of euthanasia, and expounds the view of the basic elements that should be included in the definition. After that it describes the classifications of euthanasia that most scholars accept. In the second chapter, this thesis clarifies the legalization of euthanasia is in line with international legalization trends. And then it accounts for the disadvantage of the lack of a unified criterion in China through lots of illustrations in clinical, administrative and judicial. Therefore the writer believes that legislation in euthanasia is needed in China. Then this thesis demonstrates that euthanasia legislation in China already has a solid social foundation and a sufficient legal basis. In the third chapter, combines several regulations and draft proposal, this thesis puts forward the unique, detailed, workable recommendations on many aspects of euthanasia legislation. At last, the writer gives some specific view on the procedure of euthanasia legislation.
