Study On Euthanasia Legislation

The study of euthanasia involves religion,ethics,philosophy,law,medicine and so on.The system of euthanasia legislation is related to doctors,patients,families,society and other aspects of the relationship.Therefore,euthanasia exists in our country is very controversial.In this paper,through the overview of euthanasia,it is clear that euthanasia is the problem of life disposal.After introducing the concept of euthanasia,the main elements and connotation which should be included in the definition of fatigue are emphasized again and again in the actual cases.And then through the many social problems and legal issues,pointed out that euthanasia in China's legislative work carried out at the right time.From this reason,we can sort out the general venation of the classification.In the second chapter,this paper mainly expounds the present situation of euthanasia at home and abroad.After carding the concept of euthanasia,the legislative attitude and legislative process of euthanasia in European and American law system and continental law system.It also points out that many cases have been discussed in China since 1980 s and the cases of euthanasia similar to those encountered in the actual legal work.The third chapter analyzes euthanasia cases and compares them.Pointed out that both domestic judicial cases of euthanasia or domestic case,without exception,will be the end of the dying patient suffering as an important basis for the trial verdict.Under the premise of excluding other external interference,the final punishment or judgment for euthanasia executor.Based on the common consensus of the judicial circles,the fourth chapter analyzes the necessity and feasibility of euthanasia legislation.In terms of necessity,euthanasia is the general trend of human rights development and progress in the world;in terms of legal authority,euthanasia helps to maintain the authority of the law.On this basis,the legal feasibility of euthanasia legalization is analyzed.In the medical institutions to determine the object of euthanasia in compliance with euthanasia premise,through judicial supervision,and ultimately defend the legal authority,while maintaining the dignity of dying patients dying.Finally,this paper puts forward the legislative proposal of euthanasia,which is also an important research result in this article.It is hoped that this study can bring some theoretical enrichment to the progress of euthanasia legislation in China.
