| Since the end of the last century, euthanasia has been entering into the public's field of vision due to the development of medicine technology. As an optimization ways of dying, On the one hand, the legitimate practice of euthanasia can relieve terminally ill person from extremely physical and mental suffering; on the other hand, the misuse of euthanasia can also bring catastrophe to human being. How to guide and regulate the enforcement of euthanasia is a problem which we have to face. By means of euthanasia legislation's problems as main research line, this paper explored the concept of euthanasia, procedure of euthanasia legislation and principles of euthanasia legislation respectively. The total paper includes three parts.Chapter one Based on the investigation of word resources of euthanasia and the analysis of present controversial of all kinds of euthanasia concepts and categories, this paper puts forward a new euthanasia concept and category which we should apply in our country's euthanasia legislation. In the meantime, the paper also distinguishes concepts between euthanasia concept which this paper has put forward and some other similar concepts.Chapter two Through the comparison of foreign countries' history of euthanasia legislation and the introduction and drawing of lessons from experiences of euthanasia's legislation in foreign countries, this paper reflects the present status of our country's euthanasia legislation difficulty, and states that we should advocate our country's euthanasia legislation agenda as quickly as possible. In the meantime, this paper puts forward three proposals which intend to propel our country's euthanasia legislation procedure. Chapter three Through the analysis and extraction of legislation spirit of foreign countries' Euthanasia Acts, in combination with our country's special conditions, this paper discusses four principals which should insist in our country's euthanasia legislation: sanctity of personal life can not be entrenched, informed consent and voluntary, the right of ways of dying with self-determination in certain extent restriction, strict procedure etc. |
