The Construction Of China's Ecological Damage Liability Insurance System

The "Environmental Protection Law of the People's Republic of China",which came into effect after the amendment was enacted in 2015,expressly provides for the encouragement of insurance against environmental pollution liability.The implementation of environmental pollution liability insurance is still difficult.After distinguishing between environmental pollution damage liability insurance and ecological damage liability insurance,the scope of ecological damage liability insurance covers only the protection and prevention responsibility for ecological damage,such as the imbalance of ecosystems and the decline in environmental self-purification capacity.Ecological damage liability insurance is an important system for the socialization of liability risks.Its establishment and improvement can ensure the timely restoration of ecological functions,disperse the risk of individual enterprises,maintain economic growth and social stability,and the most important thing is to have environmental benefits for the entire society and world.The ecological damage liability insurance has no legislative support in our country,and there are no pilot experiences to learn from.However,the ecological function damage caused by environmental pollution in China continues to be discussed with the theoretical community.The relevant ecological damage compensation system in practice and the third party assessment,the continuous improvement of mechanisms such as monitoring agencies and various industry-level risk hierarchies,various measures taken by the government are of great significance to the improvement of the ecological damage liability insurance system.On the basis of solving the existing problems of ecological damage liability insurance,this paper constructs an ecological damage liability insurance system in China with the relevant legislation on ecological damage liability insurance,the insurance coverage model,the scope of insurance coverage,the underwriting agency,the claim mechanism,and the third party assessment and monitoring mechanisms.
