| As for China, coal resources have always been the main and the most stable one-time energy, and the indispensible material base which guarantee the steady improvement of national economy and a harmonious development of our society. It is of vital importance to our economic development to have a healthy, successful and stable mining of coal resources. And generally, it is inevitable that mining pollutes water resources. What is urgent at present is that how to lower the pollution within the bearing capacity of the natural environment.This thesis is devoted to perfecting China’s environmental legal system so as to solve the water protection problem in mining of coal resources. This paper adopts various research methods to analyze the reasons and harm caused by the problem, the present legislation at home and abroad, and the short-comings of China on this issue. Corresponding perfecting suggestions are also proposed.This paper consists of for parts:Part1, raise the question. This part first adopts empirical analysis method to expound the main ways of water loss caused by mining coals, demonstrates that the quality and quantity of water resources are seriously diminished by the mining. Then adopting value analysis, the thesis gives an assessment of the water loss economically, and so to prove the importance of solving the problem of water protection in mining.In Part2, this paper summarizes the laws and regulations at home and abroad of the water protection in mining coals. First, the laws and regulations are carded, and China’s present legislation on the matter is comprehensively expounded; then, the laws and legislations of US, Russia and Ukraine are summed up, for they are quite successful in solving the problem. In Part3, this thesis gives an in-depth analysis of the achievements and deficiency on the water resources protection in mining of coals, and a summarizing of the features, which are:the achievements and deficiency of China’s laws on the matter have many intersections; China’s legal systems are similar to those of the foreign countries and many of China’s legal systems have the same shortcomings. And these feature demonstrate a problem, that is, it is not that the legal status of the protection of water resources is not established that causes the serious loss of water, but the deficiency of China’s environmental legal system, such as some stipulations are too inflexible, lack of implementing details, etc., which result in the failure of water protection.In Part4, with a full consideration of China’s specific national conditions, the paper proposes corresponding improving suggestions of solving the problem of water resource protection in coal mining. The author believes that to solve the water protection problem properly, first we must perfect China’s environmental legal system, which is the fundamental way of resolving this kind of problem; second is to speed up the national coal resource integration and upgrade the whole coal industry so as to protect the ecological environment; finally, an implementing of partition mining system will have a targeted protection of the environment of the mining areas. |
