Holistic Governance And Customs "supervision" System

Smuggling is illegal and criminal acts that is to avoid State import and export trade control,gain profiteering illegally,and does serious harm to the interests of national sovereignty.From the point of view of the whole process of smuggling,it is not only behavior that avoiding Customs control but also doing harm to all aspects of the national economy. China has not yet formed an effective system of comprehensive governance against smuggling,which has characteristics of train operations like "supplying,transporting,storing and selling".Anti-smuggling departments such as Customs,local government, Administration for industry and commerce and Administration of foreign exchange,still perform their own duties without cooperations.Anti-smuggling is the important functions of Customs.As the main State anti-smuggling function,China Customs has a heavy responsibility but limited power.Customs must actively promote local governments to take the lead in making closely cooperation among law enforcements,administrations,economi managements, industry authorities and other departments,in order to creat a strong fight against smuggling.Holistic Governance theory,which originated in Britain,claims that government agencies must cooperate closely in order to avoid departmental parochialism,and they must fully integrate their objectives, means and resources to effectively address the real needs of the people.So the theory has some guide to multi-sectoral coordination of governance issues.Different from the fact that the theory has received extensive attention and research and applied work in governance in the United Kingdom, the United States, Canada, Australia, New Zealand,Taiwan and other countries and regions, our theoretical study on the overall governance is still in its infancy, little practical application of research.Innovation of this paper lies in studying and exploring ways to build the Integral Anti-smuggling Customs Supervision system in the theoretical framework of Holistic Govemance,in order to improve the effectiveness of national implementation of comprehensive anti-smuggling channels and make up the lack of the theoretical research in the domestic practice of the theory.This paper begins with describing the background,main contents, governance practices and criticism corrections of Holistic Governance theory to enhance the understanding of the theory and its practical application.On this basis,we study and explore ways to build the Integral Anti-smuggling Customs Supervision system in the theoretical framework of Holistic Governance in two aspecets:cooperations between anti-smuggling departments and business departments within Customs,and cooperations between Customs and other State anti-smuggling functions.Firstly,we study the the main contents,building process and effectiveness of the Integral Anti-smuggling Customs Supervision system,and then point out issues that still need improvement in the theoretical framework of Holistic Governance.Secondly,we study three cases such as the location of Customs in the Super-ministry system reform,the dispute about iPad import duties between China Ministry of Cimmerce and China Customs,game for interests between local economic development and Customs anti-smuggling,explore how to creat a strong fight against smuggling between Customs and other State anti-smuggling functions.And then explore ways of cooperation between Customs and other social intermediary organizations in the case of Customs anti-smuggling with the cooperation from certified public accountants to form the comprehensive anti-smuggling structure of "Customs authorities,government supports and society participates".Finally,considering the actual situation of Shanghai Customs,in which the author works,we propose the further suggestions to promote building the Integral Anti-smuggling Customs Supervision system in the theoretical framework of Holistic Governance.
