The Research On Government Regulation After Transferring The Operation Right Of Tourism Scenery Area

Starting in the mid of twentieth century, the scenery area operation right transferring activities has been more than a decade. So far, hunderds of scenery areas (spots) transfer,in different forms of in almost all provinces, autonomous regions and municipalities have been carried out or encourage transfer of the Scenery area.On the one hand, transfer of scenery area operation right has been recognized in practice and showing a momentum of robust growth; on the other hand, due to inconsistencies in the policy of transfer of scenery area, causing the government lack of a clear positioning and regulatory measures in operating of the scenery area operation right transferring , and therefore , In reality, the protection of scenic resources can only rely on non-government program management and business ethics of transfereed corporate, and the scenery area management area will be involved in games of the parties, and the Government's attitude and Game behavior is very important. Thus, the tissue take game theory as the theoretical starting point to reaserch problems in the current scenery area ,take game analysisof all stakeholders of the transfer and explore the role of government regulation,and propose measures to enhance the level of government regulation. Eventually reached the following conclusions:(l) Scenery areas resources is vulnerable to be over exploited ,because the following three features in performance of the Development of Scenic Spots : Public property of scenery areas resources, Externalities of development activities and the Game between operators.(2) Although the regulatory department has been started to take some regulatory measures in the area of transferred, but the destruction of scenic resources still exists.(3) Elimination of the principal - agent relationship between the central regulatory government and local regulatory government should start from the following points: adjust the Intensity and methods of supervision of the central , Increase cost of Inaction and False in local regulatory department, to increase penalties.of local regulatory department inaction(4) Scenery area operator violations offen occurred. The phenomenon should be attributed to: the pioneer of violations to obtain first mover advantage, with the operator number to take violations increased, the various interests of legitimate business will continue to decline, eventually leading to other operators have to start taking illegal business behavior.(5) After the transfer of operating rights ,for the problems of Scenery areas, to raise the level of government regulation can be from the following three aspects: to establish incentive mechanism ,to improve the binding mechanism and improve the supervision mechanism.
