Chinese Drug Manufacturers To The Development Process Of Strategy And Study

In 2008, the State Council issued the "Outline of National Intellectual Property Strategy", which has proposed the strategy of national intellectual properties so as to enhance creation, utilization, protection and management for our intellectual property. With the implementation of this policy, China's pharmaceutical industry will face a new historical opportunities and challenges. As one of the important part in intellectual property, patents play an important role in Chinese pharmaceutical companies not only existed in the process of innovation, but also affecting business strategy. Therefore, it becomes a major issue for the pharmaceutical industry that learning successful experience from the developed countries so as to enhance independent innovation for the industry.In this thesis, we analyze the reason that the poor ability to use patent in Chinese pharmaceutical industry and studies the strategy of famous pharamcetucial company in United States and Japan.In the first part of this thesis, we introduced the concept of medicine patents such as pharmaceutical basic patent, dependent patent and the relationship between them. Then we studies the patent strategies of American and Japanese pharmaceutical companies, which includes the legal basis for protection and method for patent litigation. Accoding to some foreign-related patent litigation, we discussed the form of patent protection for pharmaceutical policy in developed countries. In addition, we introduced the historical evolution of the policy for patent protecting in our country.In the second part of this thesis, a comparative study was focused on the patent application among Merck pharmaceutical company, Takeda pharmaceutical company and all the Chinese pharmaceutical companies. Based on the difference between quantities and qualities of pharmaceutical patent, we analyze the advantage of Merck and Takeda company, and evaluate the disadvantage of Chinese pharmaceutical industry.In the third part of this thesis, we proposed the strategies how to break through the international drug patent protection in current status and discussed some successful cases of drug development aboard. These strategies include crystalline form modification, different salt formation and new formulation strategies.In the fourth part of this thesis, we summarize the patent strategies for Chinese pharmaceutical companies and give some suggestions how to do better for the patent in pharmaceutical company and use the policy from the Chinese government.
