Based On Double Digital Libraries In China The Copyright Trading Mechanism Study, Commissioned Agents

In the current digital environment, copyright law adjustment lags behindinformation technology, and this leads digital library to copyright predicament andmakes it can't fully play its role, holding back the development of digital library.Establish the new copyright balance is the most important task now. We always achievethe new balance of copyright via direct copyright law adjustment, but this easily leadsthe conflict of interest between copyright owners and general public represented bydigital library. So the law adjustment is inefficient. Copyright trade encouragescopyright owners take their initiative to diffuse their own digital works and at the sametime get royalty fee as compensation, so this is an effective approach to balance as animportant supplement of copyright law adjustment. The penman analyses the DoublePrincipal-Agent relationship between copyright owners, digital library and readers, digsout the role of copyright equalizer played by digital library as the collective agent. Andthen model the relationship and research the incentive efficiency rules. On the basis,design the digital library copyright trade mechanism with the goal of stimulating thedigital library to fully play its role of copyright equalizer and diffuse Knowledgeeffectively. And then offer proposals for the management of right flow, fund flow andinformation flow during the copyright trade, in the hope of providing properenvironment for the implementation of digital library copyright trade mechanism.
