The Research On The Mode Of Copyright Authorization For The Digitized Communications Of Books

With the development of internet and information technology, E-books and the cause ofdigital library is developing. Its unique technology advantages, such as low cost and hugeinformation quantity, are drawing more and more people's attention. Technology conditionand huge document resource are essential to the developing of digital library cause. Theproblem of technology condition can be solved relatively easily, while, the problem ofcopyright authorization of the huge document resource is more complicated. Too manylawsuits against digital library by the authors made us have to ponder. Lacking the law senseof digital library is the reason for it, but whether there is a bottleneck in the system, whichprevents the digital library from getting the copyright authorization legally and conveniently?What are the copyright authorization modes of books presently in China, and what arethe advantages and disadvantages of them? And what kind of copyright authorization modecan embody the authors' protection of the copyright and at the same time promote thedevelopment of the digital library cause? Considering the thinking on the problemsmentioned above, this paper makes an analysis on the present mode of copyrightauthorization of digital spreading books by using the methods of historical analysis,conception analysis, comparative research and case analysis , and on this basis proposes theviewpoints of the author.This paper consists of four parts. The first part introduces the influence of the appearingof digital technology on the document spread. The second part introduces the carriers andways of the digital spread of books. And with the lawsuits against digital library by thescholars in recent years, deeply analyzes the system reason of the copyright infringementlitigant, and also comments on the present solving modes of copyright authorization of digitalspreading books. The third part makes an analysis on the present modes of copyrightauthorization. And in the finial part, the author proposes the viewpoint that we shouldanalysis the problem of copyright authorization of digital spreading books comprehensivelyand systemically, and claims to take the protective technology for the digital copyright. Andalso claims that taking what kind of protective mode should be decided by whether the bookshave been published or not. If it has been published, we may take the solving way ofcombining the enlarged scale of legal permission with the collective management system. Ifnot, the bookmen should be the agent for the authorized copyright.
