The freedom of the Press as a kind of right extending form the Saying and Press freedom has the significant effect in the construction of modern Constitutionalism.The freedom of the Press is the cornerstone of Constitutionalism and the means of expending the democracy.It can promote the construction of legal system advertise it.The freedom of the Press is not only a kind of fundamental Human Right but also can promote the realization of the other rights.So,The freedom of the Press is so important for China which is in the critical stage of Constitutionalism's construction,that,it's worth and effect is not can be took of. This article will start from the concept and the origin of the freedom of the Press,and then analysis the difference between the freedom of the Press and the Saying and Press freedom.I will define the limit of the freedom of Press,too.It is to say, the freedom of the Press is not another kind of expression of the Saying and Press freedom. It is an fundamental Constitutional right.Next, I will deeply discuss the effect of the freedom of the Press in promoting democracy□construction of legal system and protecting of Human Right. The article is mainly discuss the protection of the freedom of Press in modern China and the drawback in legislation judicature.This article use the comparative method to introduce the difference between the common law and the civil law in the protection of the freedom of the Press.Then ,use their experience to perfect it.At last we should start from the legislation.Perfect the context of the Constitution and draft the Press Law to make sure the law as the main strength in protecting the freedom of Press.In practice we should reinforce the regulation expending the rage of right belongs to the media,improve the quality of media,establish the Press Association. To make sure the methods which are used to protect the freedom of Press can be carried out.At the same time, we think the protection of the freedom of the Press is a gradual process.We should take some more gender method to perfect it. Never act with undue haste to prevent the anxious of people and the unrest of the society.
