Study On The Construction Of Administrative Law Enforcement Credibility

In march 5th 2005, the state council premier Wen Jiabao mentioned in the government work report of the third session of the tenth npc, "we should promote government affairs public energetically and strengthen the e-government construction, and enhance the degree of open politics,and improve the government credibility." He pointed out clearly that strengthen credibility is one of value goals for administrations. Administrative law enforcement credibility is people's subjective value judgments and mental reflects for the public administration and its staffs administration actions. It directly reflects the degree of respect, identity and support for public administration and law enforcement work. The consequences of Administrative law enforcement credibility can influence the social stability and unity, stability and prosperity seriously. Therefore, improving the credibility of executive authorities is very important for promoting our democratic country'construction, and constructing our socialist harmonious society. However, with the improvement of socialist democracy construction, People have a high demand of social equity and justice. Particularly in the new situation of open, transparent and information, law enforcement activities of law enforcement organs become the focus of all sectors of the community and news media. Some law enforcement action which is not adapt to socialist legal system requires, these actions will become the fuse of a variety of deep-rooted conflictsSince the reform and opening, we have made great achievements in standardize and improve the administrative law enforcement actions, and increase law enforcement credibility. Especially with accelerated process of political restructuring and the government functions from the all-round to public-service-oriented, enforcement actions of administrative organs is in the orbit of democratization and legalization. On the whole, the agency's enforcement credibility is very good. But compared with demands of promoting law-based administration and building a country under the rule of law, the state quo of administrative law enforcement credibility construction is far from being satisfactory. Because some deep contradictions and problems are not solving radically, the credibility of administrative law enforcement departments and sections is decline. This affect the government's overall image, and increase costs of administrative actions, and the consequence of law enforcement is not obvious. In the process of promoting law-based administration and building a country under the rule of law, it is very important project for construction of administrative rule by law that how to rational analysis the problems and the root, and make some useful countermeasures to improve law enforcement credibility.This thesis can divide into four parts. First, this thesis introduces the content and characters of the administrative law enforcement credibility from the basic theory of administrative law enforcement construction. And, it makes theoretical explanation of social factors and social theory of the administrative law enforcement credibility construction. At the same time, it introduces some foreign relevant system of improving the credibility construction, and analysis the difference between China and foreign countries.
