As the main artery of national economic development,transport plays a basic,service-oriented and strategic role,and is essential to rejuvenating the country and the basis for strengthening it.In 2018,the General Offices of the CPC Central Committee and The State Council issued the Guiding Opinions on Deepening the Reform of Comprehensive Administrative Law Enforcement in Transport.In December 2021,the Ministry of Transport issued a document,making specific requirements for deepening the reform of comprehensive administrative law enforcement in transport,requiring continued integration of law enforcement teams and related responsibilities,and promoting the comprehensive reform of transportation administrative law enforcement at the provincial,municipal and county levels;It is clear that the comprehensive administrative law enforcement mechanism should be more perfect in operation,and the division of responsibilities should be clearly divided to avoid the absence and dislocation of supervision tasks,so that supervision can form a joint force;It also requires the transportation comprehensive administrative law enforcement department to strengthen joint law enforcement,information sharing,emergency linkage with public security and other departments,and improve the work system of cross-regional law enforcement cooperation,case transfer and cooperation.Since the reform of transportation comprehensive administrative law enforcement started,the provincial transportation management departments have combined the law enforcement agencies with their own actual conditions to set up transportation comprehensive administrative law enforcement agencies.As of December 2022,China’s transportation comprehensive administrative law enforcement system reform at the provincial level has been completed,forming a new transportation administrative law enforcement system.Through the reform,the provincial traffic administrative law enforcement departments have integrated their teams,reduced the levels of law enforcement,and solved the problems of overlapping agencies and repeated law enforcement.With the amendment and improvement of the "Highway Law" and other laws and regulations,the comprehensive law enforcement of transportation continues to advance to the grassroots level,from the actual effect of the reform of comprehensive law enforcement of grassroots transportation in China,it does solve some problems that have existed for a long time in traffic law enforcement,but there is still much room for improvement with the goal required by the central government.The grassroots traffic law enforcement departments still have problems such as non-uniform establishment,scattered law enforcement forces,abuse of administrative discretion,and irregular law enforcement procedures,which affect the image of the traffic government departments,and some deep-seated problems in the grassroots law enforcement units have not been fundamentally solved after the comprehensive reform of traffic and transportation administrative law enforcement.This paper comprehensively and systematically sorted out the problems existing in law enforcement subjects,law enforcement authority,law enforcement procedures and law enforcement supervision in the process of comprehensive administrative law enforcement of transportation by using literature research method,system theory method and comparative research method,clarified the scientific connotation of comprehensive administrative law enforcement of transportation,and drew lessons from domestic and foreign experience and inspiration in traffic law enforcement.The countermeasures and suggestions of strengthening the construction of traffic law enforcement team,perfecting the functions and powers of law enforcement subjects,optimizing the implementation system of law enforcement procedures,and constructing the traffic law enforcement supervision system are clearly put forward. |
