Improvement Of Chinese Legal System Of Climate Change

The aim of this article is providing better program for Chinese climate change combating law. Firstly, this article illustrates the concepts character and influence on human beings, then I get a conclusion that it is necessary to combat climate change with the method of law. Secondly, I analyze the theoretical basis of climate change combating law including concept of sustainable development philosophy of law and legal economics. Thirdly, this article illustrates legislation of European Union, Britain,Japan,The United States of America and china, then I found the discipline of law of developed countries and china. Finally I illustrate the principle and formula of Chinese climate change combating law after combining experience of developed countries and shortcoming of Chinese law. I finished this paper with a method of comparative study. The innovation of this paper is illustrated below: combination of thread of thought of legislation and way of combating climate change, the whole system of climate change combating law could be divided into palliation part and adaptation part, palliation part could be divided into energy efficiency improving part and new energy development part, it is necessary to conduct targeted legislation of institution in energy efficiency improving part and new energy supporting part, adaptation part could be divided into areas of agriculture,water resources,ocean,health and meteorological, tax and market legal system should be reinforced to provide financial support for energy efficiency improving and new energy development.
