serious challenges facing human society in the 21 st century.Climate change has now risen to a global concern.On November 4,2016,the "Paris Agreement" came into effect,and each of the contracting states is facing the issue of how to modify their domestic climate change legislation to echo the agreement.China,as one of the signatories,must also participate in it.Since the 18 th and 19 th National Congresses of the Party were held,China has raised the construction of "Beautiful China" to a national strategic level,and environmental protection has received unprecedented attention.The prevention and control of air pollution plays an important role in tackling climate change.Especially in recent years,the frequency of severely polluted weather in China has increased year by year.Hot words such as "smog" and "pollution index burst" have been frequently searched and increased.In response to the importance that citizens attach to the problem of air pollution,a series of corresponding measures have been taken at the national,government,and social levels to address air pollution.This article mainly expounds the legal countermeasures or suggestions to deal with climate change from the perspective of the air pollution prevention law.It consists of three parts.The first part mainly introduces the importance of climate change response to air pollution,and then gives a brief overview of climate change and air pollution.China has played an irreplaceable role in the signing of the Paris Agreement and has set a good example globally as the world's largest developing country.At the same time,it cannot be ignored that China,as the country with the second largest amount of carbon dioxide emissions in the world,still has a long way to go in fulfilling the stated goals stipulated in the Paris Agreement.Therefore,difficulties in many aspects require us to work hard.get over.The second part first focuses on analyzing the current status and problems of China 's air pollution prevention legislation.From the author 's perspective,it presents the problems and deficiencies in China 's current relevant legislation.Under the current environmental protection trend,it is necessary to formulate laws to address climate change.The necessity of the system.Secondly,I will introduce the experience and lessons learned from overseas related laws and regulations on air pollution.Taking Britain,Japan,and the United States as examples,learn the measures taken by these three countries to control air pollution,from the formulation of laws and regulations to mobilizing the public.Participate in the protection of the atmosphere,draw its essence,and learn from the work of preventing and controlling air pollution in China.The third part mainly introduces the legal measures taken to combat air pollution in China.First of all,at the legal level,it is necessary to revise environmental laws and develop new laws to supplement contemporary environmental legislation.Establish air pollution prevention and control as the main area of ??legislation for pollution prevention and control.Continue to explore relevant clean production legislation.Second,at the government level,the government should take the lead,strengthen the government's support for air pollution control,improve the specialization of China's air pollution environmental justice,and guide enterprises to speed up the process of coal abandonment.Thirdly,it is necessary to establish and improve the compensation mechanism and social relief mechanism for air pollution infringement in our country,strengthen the construction of environmental liability insurance system,and improve the system of procuratorial organs' participation in public interest litigation.Finally,the principle of public participation must be fully implemented and improved.
