Research On The Envioronmental Protection Legal Issues During The Real Property Development

Residence, as one of the living essentials, has always been a major concern of human beings in the history. With the fast development of real estate economy and the continuous renovation of residential policy in our country, real estate has become a special commodity which occupies a more and more important position in people's life. Meanwhile, people gradually realize the importance of protecting our environment. All facts prove that rational use of resources and control of pollutions can provide a better living and working environment for people and consequently ensure the sustainable development of economy. Therefore, real estate exploitation and environment protection are no longer two irrelevant issues. No profit should be made by sacrificing the environment.However, due to lacking of well-established laws and regulations, real estate industry in our country has developed in an unhealthy way. Ignoring the protection of environment and even destroying environment often occur in the construction of new residential areas which have left many environmental problems to the future. When we have the economic laws to regulate the macro-economy and the civil law and commercial law to protect the justice in business, we need to have a sophisticated law system as well to ensure the sustainable development of real estate industry. This article will discuss the relationship between real estate development and environment protection and the necessity of having a law system to protect the environment. Based on the discussion, some suggestions are given on how to establish the related law system.This paper consists of four chapters. The first chapter draws people's attention to those environment problems existing in the real estate industry. The second chapter briefly introduces the most popular legal problems related to environment protection in real estate industry. In the following chapter, the author analyzes the deficiencies of environment protection laws in our country and points out the vacancy of related laws to regulate the real estate industry. Singapore and Hong Kong's successful experiences are introduced in the last chapter. Based on their experiences, the author gives suggestions on how to establish our own law system to prevent environment problems in real estate construction.Environment problems have significant and long-term influence on the improvement of economy and society. The result is self-evident if we sacrifice environment to construct our home. Laws and regulations is indispensable for not only real estate industry but also all other industries. The author hopes this article will arouse people's concern towards this.
