There are a wide variety of organisms what are a valuable asset of all mankind. Biodiversitymaintains the ecological balance of nature and provides a good environmental conditions forhumans'survival, biological diversity is an integral components of ecosystem. However, withthe development of economy, people continue to disrupt ecological environment in order toachieve the economic purposes, resulting in abnormal climate change, natural disasters occurfrequently, species decline rapidly and rare plants are close to die out. As an importantcomponent of biodiversity ,wild plants not only plays an important role in maintainingecological balance, but also have a lot of economy, tourism, culture, scientific research value.Since 1984, there have being formated more than 100 international treaties, multilateralagreements and bilateral agreements about the protection of wild plants. Since then, theprotection of wild plants has gradually to be concerned about. The "Regulations on Protection ofWild Plants" which the State Council promulgated in 1996 is a administrative regulations whichprotects the wild plants.As biological diversity, wild plant resources are the material basis for human existence andsocial development. The unique ecological value of wild plants play an important role in theprotection of human survival and living conditions. In the case of wild plants increasinglysuffering serious damage, the legal system of our country on the protection of wild plants is notperfect. This paper uses many methods such as theoretical analysis research methods,comparative research methods and methods of interdisciplinary to explore a variety of legalsystem issues of wild plant protection.The first part starting with the basic concepts of biodiversity conservation, discusses thebasic concepts of biodiversity and the theoretical basis of biodiversity conservation. Thenintroduces the basic concepts of conservation of wild plants on the based of discussingBiodiversity conservation. Meanwhile, it elaborates the concept of wild plants and thedevelopment of wildplants-protected. The second part describes the status of legal protection ofwild plants and points out the problems. The third part began to introduce foreign status of thelegal system of the conservation of biological diversity and the profile of wild plant protection,such as America, England and Australia. Further, analysis out the experience of foreign-relatedlegislation which we can learn from. The fourth part point out the improving the measures oflegal protection of wild plants combining the specific conditions in our country. Including the improvement of the system of wild plant protection legislation, treasuring the ecological value ofwild plants, expanding the scope of protection of wild plant resources, improving the legalresponsibility of the protection of the wild plants and heightening the citizen's awareness ofenvironmental protection of wild plant resources, so as to achieve the purpose of protection ofwild plants.
