The resources of wild plants in china is enrichment, which take up the third around the world. But the reality of it in china is there are a great amount of people so that the average of the resources of wild plants is few. So we should treasure the resources of wild plants. Now the content s of the roles of wild plants protection in our country are not perfect, and the rules can not be executed properly. Because of the limitation of the legislation and execution of the wild plants protective rules, the wild plants in china could not be protected properly. With the development of the modern economy, the phenomenon of destroying the wild plants is more and more serious. Therefore, this paper adopts many study methods, such as comparison method, literature method, fieldwork method, spot survey connected with concrete evidence and so on. And proves the necessities and concrete suggestion of construction a WILD PLANT PROTECTIVE LAW.First, this paper introduces the status of the wild plants protection of our country especially the phenomenon of destroying the wild plants. That can help us to know the problems in the legislation and execution of the wild plants protective rules and adop some methods to perfect it. Secondly, this paper introduces some legislation on ertemal wild plants protective law. Thirdly, taking apart and studies the problems of wild plants protective law in management system, legislation system, executing the law, legal liability. Finally, the paper probes into the instrument and amendment to wild plants protective rules, That is, modificating the wild plants protective rules currently in China, studing out a draft of WILD PLANT PROTECTIVE LAW of our country. Changing rules into the law is helpful to the perfect of legislation and execution of the wild plants protection.
