The Exploration Of Biodiversity Ecological Service And Payment Law In Qinling Mountain

As the prime minister of Mongolia said, resources are not inherited from our ancestors but from our descendants. With the rapid development of economics, human beings got amounts of wealth through the overexploitation of the nature resources, which also ruined our environment. The developed countries have realized that there are different ways to improve the environment in an early time and they have tried in many paths. As an indispensable choice, law can strengthen the citizens'awareness and regulate their behaviors. Ecological service and payment law system aims to combine the economics with law to change people's improper attitudes towards the natural environment, so as to avoid excessive consumption of nature resources.Nowadays many nations try to explore the function of service and payment law to recover ecosystem services. China also did the same thing which started from the field of forest ecosystems. The western region of China is rich in natural and biological resources. However, the ecological environment here is fragile and even has been damaged. As is known to all, Qinling Mountain is located in the west of China. It not only undertakes the stability of the ecological environment in the west region but also affects the trend of the development of the whole ecological environment in China. Therefore, Qinling Mountain plays an important role in China's environmental protection and ecological stability. Because of the unique hydrological conditions and abundant species resources in Qinling Mountain, many policies could be practiced in legal construction of service and payment law. The exploration of biodiversity ecological service and payment law is one of the most important perspectives.This dissertation analyses the biodiversity condition, the existing legal and policy in both China and Qinling Mountain and considers the local economic development current situation and living standards of local residents, so as to find the problems and dilemmas of the biodiversity protection. Hoping that biodiversity ecological service and payment law in Qinling Mountain can help to make the regional biodiversity conservation and restoration go easy.First of all, this article describes the status of biodiversity conservation in China, the existing policies, regulations and strategic progress, then analyses the concept of ecological compensation, the compensation of the main and other related content clearly, and also defines the conception of service and payment law. After discussing the relationship between biological diversity and ecological compensation, the conclusion goes to that biodiversity ecological service and payment law is an effective measure in biodiversity conservation. At the same time, through analysing the United States and India's successful experience in biodiversity protection law, the author gives China some references.Taking full account of the local economy and the environment in Shaanxi Province and Qinling Mountain, the author considers that we should clarify the mission in biodiversity ecological service and payment law in Qinling Mountain, understand the significance of biodiversity ecological service and payment law in Qinling Mountain and grab the key of biodiversity ecological service and payment law in Qinling Mountain and so on. Meanwhile it should be constructed the principles as follows: combining sustainable development principles with systematic fairness principles; combining balancing principles with interests principles; combining full compensation principle with gradual and orderly progress; combining the government with the market.In order to constructing the biodiversity ecological service and payment law in Qinling Mountain, we should bring the ecological service and payment into the national economic planning, increase the degree of public concern of ecological service and payment law in biodiversity conservation, clarify the main parties in biodiversity ecological service and payment law, improve the protection of the rights of legal subjects in ecological service and payment law in Qinling Mountain, promote cataloguing biodiversity by law, find reasonable ways of compensation in biodiversity conservation in Qinling Mountain, make the concept of funding sources, compensation standards and limits clearly, establish a scientific cadre appraisal system. Meanwhile, we should pay attention to the publicity of the policies and regulations of biodiversity conservation in Qinling Mountain.Finally, this paper aims to explore a meaningful reference to the biodiversity ecological service and payment law in Qinling Mountain area, which could make the environment of Qinling Mountain better.
