Study Of State-owned Enterprise Human Capital Property Right Path

The property rights of human capital is the hotspot that have been researched by the academic, business and government recently. Theodorew. Schultz, Jacob Mincer and garys Becker etc. established and developed the human capital theory. Zhang Wei-ying, Zhou Qi-ye and Yang Rui-long etc. elaborated the human capital and the property theory of our state-owned enterprise.This paper re-defines the concepts of the human capital, human capital property right, and so on, pointes out the human capital's attributes of adherence, developable, changeable, effectiveness, risk, social etc and puts forward some important problems that has to be resolved if we want to fulfill the property rights of human capital of the state-owned enterprise. Our country started the reform of the state-owned enterprise's property rights of human capital when we faced the severe problem that the general efficiency of the state-owned enterprise was lower. But it just stayed at the level of the enterprise's management. However, for the general staff, it pushed the non-property rights of human capital. Therefore, it influenced the activity of labors and the economic efficiency of the enterprise. Moreover, it accelerated the outstanding and complication of those contradictions and problems that are the losing of human capital, the declining of human capital investing power, the lower efficiency of the encouragement and restriction mechanism, the poor level of the total operation efficiency, and so on. In fact, the reform of the state-owned enterprise centering on property for twenty years have never come out of the thinking pattern of "only goods, no people". It is not doubt that the human capital and its property rights is the key to make the state-owned enterprise get rid of the embarrassment and regain the power.By analysis, at the angle of institutional economics, this paper puts forward the logic way of the state-owned enterprise's property rights of human capital. That is constituting a series of legal administration structure of legal human capital property rights; controlling power to transfer to the manager level; the reward of manager linking up with the enterprise's profits; the manager, technical human capital and general labors owning the legal human capital property rights and normal encouragement, control, transform mechanism; forming complete demanding rights of enterprise surplus; establishing perfect guarantee mechanism of human capital property rights including contract, law, society, policy, market. In short, constituting the system and operation mode of the state-owned enterprise's human capital property rights is the requirement to resolve the deep contradiction of the state-owned enterprise and the best result that the state-owned enterprise looking for. The state-owned enterprise's property rights of human capital benefits to the accumulation and circulation of the human capital, the perfect of the administration inside the enterprise and the constitution of the modern enterprise system.
