Legal Protection Of Network Virtual Property

Due to the rapid development of information technology,the internet exists in our work and all the aspects of life.The virtual property which lies in the internet brings all kinds of disputes and can not stop to impact our existing legislation,bringing huge challenge to the traditional legal theory.The attitude of citizens to the virtual property changes from blindly boycott to later slowly accept,and now it is widely used.It represents the cognitive process of new things.However,the legislation is slower than the development pace of internet in our country.the academia has been arguing on the property attribute and legal attribute of the virtual property,and problems like applying which law to regulate it as well.For such disputes in our country,they lack clear definition whether in legislation or judicial practice which makes such cases without laws to depend.With the rapid development of the internet industry,such cases will be more complicated and various.If they still don’t have a right definition,it is harmful not only to our protection of virtual property,but also to the legal interests of parties.The paper beginning with the current situation of legal protection to the virtual property, analysing the feasibility of real right law,explore the feasibility of petition in rem to it.It consists of three chapters. The first chapter analyses the current situation of protecting the virtual property both here and abroad.The second chapter analyses property and real right attribute to explore the feasibility to protect it by real right law. The third chapter explore the feasibility of petition in rem to virtual property.
