The Absence And Perfection Of The System Of Judges' Protection

The guarantee system of judges is a general designation of a series of guarantee system which in order to realize the judicial independence and to ensure the independence of judges in exercising judicial power. Most countries in the world, especially the states under the rules of law, have developed a perfect guarantee system of judges. The existing legal system of our country is only a simple rule for the principle of independent trial of the court, our country has not detailed and cleared the independent judicial power of judges in legislation. In addition, the right entitled to the judges in the "law of the judges" has not been carried out. In order to construct and improve the guarantee system of judges in our country, firstly, we need to clarify the limits of power and responsibility of post judge, judge assistant and judicial administrative personnel. Secondly, improve the salary level of judicial officials hierarchically according to the results of reforming of the posts. Thirdly, provide guarantee for the judges in exercising judicial power independently in the legal system. Finally, design a legal system which can protect the lives and safety of judicial officials and their immediate relatives so as to solve the judges’ worries, and ultimately realize judicial independence, and make everyone havethe sense of fairness and justice in judicial cases.
