Curb The Detention Of Violence And Detention System Reform

Jail violence is the violent occurrence in the jail which causes injury, disability or even death of detainees. The jail is a place of detention where personal freedom is restricted, as the same as the other regulatory sites, such situation as mistreatment by supervisors and "the bull in prisoners", is a serious threat to the personal rights and other rights of detainees, which is also seriously disrupted the supervision and management in the jail. The jail should have been a place to educate and reform the lawbreakers and a "special educational institution" to them, however, it has become a potentially dangerous place due to the existence of violence, where the detainees are lack of protection of human rights and even the personnel safety.In the first part of this paper, it defined the concept of the administrative detention and jail, and the boundaries of them. The second part of this paper mainly discussed the catogaries of violence in jail and the causes. Firstly, discussing the types of jail violence and its general causes; then, addressing the types of violence from other detainees and its special cause, and finally, discussing the types of violence from supervisors and its special causes. Through the deep analysis of the types of jail violence and its causes, we could find the key factors of the problem and the way to solve it. In the third part, this article put forward some proposals on detention reform based on the above parts, which comprised the reform of administrative detention's institution, the supervision of detention managenment, the construction of supervisor teams in the jail, the improvement of living conditions of detainees and implementing the management of detainees in different sorts.The final purpose of researching the jail violence problem is to find the correct reformation ways of China, prevent the occurrence of violence existing in the jail, and guarantee the basic human rights of the detainees fundamentally. It is very important to change the prevailing situations of"restricting without education", and turn the jails into a special school of lawbreakers.
