Since the Reform and opening-up, with the socialist market economy system established gradually, it becomes more active that rural surplus-labors move to city and form a special hierarchy-immigrant peasant. They have become an important part of industrialist in our country, most of whom are engaged in mining, building, manufactoring and other labor intensive industry. They are main force of the construction of the cities, who make a tremendous contribution to China's modernization development.Immigrant peasants are also faced with a series of new problems of professional transition, among which many legal rights are out of protection. Professional safety and health tend to the focus of society because of its direct danger to personnel safety and its great social influence. Especially, immigrant peasants are lack of right of work safety. The infringement of legal right of work safety will increase economic burden of immigrant peasants' families, deteriorate their negative mentality as well as create immigrant peasants' injury and disability, which will do no good to companys' healthy development, broken common order of socialist market economy, obstruct usual transition of rural surplus-labors, defer the modernization drive, even tend to cause contradiction of urban and rural, and influence social order and stability.Right to life and right to health are the base of other rights, so if immigrant peasants have no life and health, all of other rights lose the possibility of existence and it will be nothing to protect the rights of immigrant peasants. To a certain extent, the lack of the protection of immigrant peasants' right of work safety will influence our country's social transition,the solution of agriculture-countryside-farmer, realization of modernization drive and have respect to immigrant peasants' vital interests as well. Therefore, it has important realistic meaning and strategic importance to study protection of immigrant peasants' right of work safety.This text uses general theory of social investigation to arrange and introduce the protection of immigrant peasants' right of work safety in our and foreign country systemically, analyze the current situation of the protection of immigrant peasants' right of work safety and think about the constructive suggestions of the protection of immigrant peasants' right of work safety to provide conference of enhancing, deepening and expanding theoretical research throughout the survey to 1000 immigrant peasants in Y district by questionnaire and the interviews of 50 immigrant peasants.On the basis of abundant investigation, we have the conclusion that immigrant peasants' right of work safety is out of protection and it has been a threat to their right of life and right of health. So we should improve the judicial systems of immigrant peasants' protection of work safety. And we should also establish a mechanism of protection of work safety with a bondage among government, industry and peasants.
