| Stepping into the new century,the demand to the natural medicine of international medicine market presents swiftly increasing.The TCM as our ancient culture's treasure is attracting more and more attention from the world consumers,by its outstanding features of the natural raw material,the complex therapy,treating the symptoms and the causes,the medical fitness.Our TCM industry with centuries-old TCM theory and culture has the incomparable advantage compared with the chemical medicine and biological medicine.However,there are many problems on the TCM patent protection,such as the weak protection consciousness,the deficiency of protection measurements,and the imperfect protection policy. Therefore,its superiority of intellectual property rights has not been manifested.Through using some research methods,such as document research,statistic analysis research and comparative research,we firstly make a systematic review of the changing process of the TCM patent policy and its influence on the industry. Then,we make efforts to find out the policies that are disadvantage to the TCM industry.Finally,we put forward some measures to improve our TCM patent policy by introducing good experiences that are used to protect traditional medicine in some countries.We can take these measures to improve our TCM patent policy:Firstly, strengthening the patent protection of the TCM knowledge;secondly,extending the period of the patent protection for TCM invention;thirdly,making TCM patent examination principle conforming to the TCM characteristic;fourthly,making the well targeted measurements to patent right protection;fifthly,making the high level encouraging and leading policy on TCM patent application. |
