Facing the situation of demand beyond supply continuously in labor market, as a whole and the system of Labor law is not complete, the powerlessness of the labor has been reinforced in the verse of the labor and the Capital. The lawful rights and interests of the employee have been violated frequently. In order to protect the lawful rights and interests of the labors, the government formulated a series of labor and regulation .And with these law and regulations has been assigned, labors improved their consciousness of maintaining rights. As a result, the number of the labor dispute increases rapidly, Which has challenged the labor relation system badly.As a prime way to settle the labor disputes, mediation not only has low lost, but also can settle the disputes timely and effectively. But because of some reasons now, mediation did not play a big role in labor dispute. And lots of cases enter into the arbitration stage immediately.The author of the thesis has drawn some conclusions base on the analyses of the mediation mechanism of the disputes at this stage. Firstly, the internal mediation decision of enterprises has not been established. Secondly, not only the number of grass-roots mediation unit should be increased, but the people adjuster team also need to be strengthen. At last, the labor lack the awareness of mediation when they in the face of disputes always.In the last part of the thesis, the author put forward some measures according to the issues above mention. At the first, the law of mediation system should be perfected. In the second, the labor administration department ought to supervise and prod the enterprises to establish the internal mediation decision. In the third, the situation of the grass-roots mediation unit and the quality of the conciliation officer should be improved. At last, the labor administration department should help the labors enhance the legal awareness. |
