Research On Compensation Mechanism Of Land Expropriation In Our Country

Our country is a big agriculture country and the most villager-populated country,so the village land is vital to farmers'and country benefit.With the acceleration of industrialization and urbanization in our country,lots of rural collective land are confiscated and many peasants become landless peasant.When the peasants lost their land,the government must resolve their survival and development issues,which results affect the social stability and development.However,because of the weakness of compensation mechanism of land expropriation,the big pressure of employment and the morbidity of social security system,the situation of landless peasant's life is worse than that before the land is expropriated.Some even become the vulnerable groups called the"Four noes",who have no land,no jobs,no money and no security.Therefore,the issue of landless peasant is the focus of the government and society,creating many discussions.Based on the former research,this article studies the basic theory of economic compensation for landless peasant,describes and analyzes the present situations and nature of,as well as the reasons for,the issue of compensation for landless peasant,dissects the practice in our country to develop a compensation mechanism of landless peasant,and explores the ways to handle the landless peasant issue from a perspective of developing a scientifiec compensation mechanism.This article is divided into six parts.Except the backgroud and basis,the preamble mainly discuss scholars',at home and abroad,research on compensation mechanism of land expropriation,including the origin,theory,standard,principle,range and ways of compensation.The second part is theoretical foundation of the compensation mechanism of land expropriation,mainly discussing the theoretical basis,theory of Scientific Development,theory of Social Security.The theoretical basis consists of theory of property rights,rent theory,utility theory,theory of compensation of expropriation.The third part analyzes the present situation of land compensation.In order to give a clear analysis,this part expounds from three aspects.The fourth part discusses two aspects. One is the development of compensation mechanism of land expropriation,in which reviews the starting,adjusting,perfection and development.It analyzes each phrase's characters and regulations.The other aspect studies the weakness of present compensation mechanism of land expropriation.In this article,the weakness comprises of fuzzy subject,unreasonable standard,inflexible ways and imperfect procedures. The fifth part points out the principles of perfecting the compensation mechanism.The last part gives some advices,which are clearing the system of land ownership and the subjects,improving the compensation standard,building the system of employment and social security.
