The Research On The Legal System Of Land In Ecocity

With the development of society, economy and environment in China, the legal system of land had also experienced many transforms, from focusing only on the economic resource property of land in the past to the natural resource property of land now, from using land in an unreasonable way to a sustainable and rational way, from emphasizing the development of economy to achieving the harmonious development of the economy, society and environment. However, because of the shortcomings of our traditional legal system of land in the urban region, many cities of our country are suffering some serious disease such as environmental damage and pollution, urban congestion, heat island effect etc. In order to improve the living environment in the urban region, it needs to establish a development mode of ecocity in our state. The ecocity is an ideal mode of habitation. It needs the human being to respect the nature, to keep the human and the nature in harmony. People need to change their way to produce and live, to set up the concept that the environment always comes first. The construction of ecocity needs to ensure a rational use of land which based on the environmental carrying capacity of land, and to promote sustainable use of land. Ecocity pays attention to the program of the infrastructure, green space and ecological land, and gives special protection to them, in order to ensure the rational structure of land in the urban region, and to promote the harmonious, efficient and sustainable development of cities. Although more and more interrelated regulations and policies of land in our state, embodied the demands of ecocity, there were still some shortcomings in the land system, as the wrong idea of the land use in our country, and the deficiency of our land legal system. So we face a comprehensive reform in the land legal system to establish and perfect the system of environmental compensation, and to ensure the ecological protection by an economical means. To improve the system of the allocated right of the use of the land, to emphasize the priority of land use in the infrastructure, green space and ecological land in the urban region, to improve the system regulates land-use, and to emphasize a special protection of the infrastructure land, green space and ecological land, it needs to perfect the system of Yellow Line, Green Line and Blue Line in the urban planning.
