Study On Prevention Mechanism Of Work Injury Insurance

Work injury insurance system is an important constituent of social security system. The union of work injury insurance and accident prevention is one of the basic functions of work injury insurance, which also is the basic requirement and the cardinal principle for carrying out this social insurance. Social development,the improvement of work injury insurance system and the expansion of work injury insurance function derive the prevention function of work injury insurance, which play an important role in improving enterprise security situation, promoting economic development and social stability. The prevention of work injury which has caused governments concern and attention to the prevention of work injury has become the world's work injury insurance system reform trend.China's existing work injury insurance system is, "focus on treatment, prevention belittle", the negative mode of compensation. First, the legal rule lacks the actual contents of injury prevention. "Production Safety Law" and "Work Injury Insurance Regulations" have no corresponding expression of how to achieve work-related injuries prevention function. Next, the management by supervision has the department function overlapping. Labor and social security departments and safe production supervision administrative bureau have the function overlapping on the supervision and management of accident prevention. Third, China has not taken full advantages of the rate mechanism, which is playing a key role in accident prevention. Differential rates have few differences, the gap is too small and float rates can not give full play to incentives.On the base of proposing the above problems of Chinese prevention mechanism of work injury insurance, this article introduced the success of Germany prevention mechanism of work injury insurance in detail, such as perfect laws and regulations, efficient management structure, flexible economic control measures, and so on. Through analyzing the measures of Germany prevention of work injury, we can learn from some of the following: enhancing the legislation grade, improving the management system of work injury insurance, expanding the scope of work injury insurance insured, formulating scientific and rational rate mechanism, carrying out education and training in safety and security technology research.To further improve Chinese prevention mechanism of work injury insurance, it is very necessary to study the preventions of work injury on legislation, safety and economy measures. On the legislation of work injury prevention, this article proposes to enhance the legislative grade of work injury insurance, to carry out the actual content of work injury prevention and to clear the department of supervision and management. On the union of work injury prevention and production safety, it is emphasis to carry out education and training and to establish the technical support mechanisms of production safety. On the economic measures to realize the prevention function, it is summarized as extracting prevention fund reasonably using prevention fund effectively and formulating scientific and rational rate mechanism. Through improving prevention mechanism of work injury insurance, we can reduce and control work injury's occurrence, eliminate the accident in the embryonic stage, and avoid the harm to the community, businesses and individuals.
