Researching On The Long-term Compensation System Of Land-collection And Land-purchasing

With the consisting development of the construction in the cities in China, more land-collection activities occurred which causes more farmers to lose land where they used to make a living from. Thus, an important and urgent problem of the compensation for the farmers whose land have been collected away arises during the process of the urbanization in China. This problem should be sorted out as soon as possible because it concerns the benefits of the farmers and the development of the urbanization.But we do not have a complete and meticulous law system about the land-collection, land-purchasing compensation problems currently. What we do inpractice is to compensate in currency at one time. This causes puzzledom for those farmers making them " no land to plant. no employment to search. no social securityto enjoy" under the current market economy environment. As time goes on, once the landless farmers use up the limited compensation money, a vicious circle of "compensating—using-up—compensating again" would appear as a result. Therefore, hereby we put forward a reformation making the one-off compensation into a long-term compensation to solve the above problem.This thesis consists the following basic propositions and conclusion: supplying the landless farmers with basic life security to upgrade their independent survival abilities as the basic rule; confirming the property of the land-collection by the future collective land usage and its planned function to separate the collection and purchase of the land to set up a security system of the farmer community; creating more employment and living condition for the landless farmers; changing the one-off compensation into multi-compensated means to let farmers have sustainable way of spending money; developing the limited compensation to long-term compensation; forming a fair and effective land-collection compensating system and its attached system.This thesis structured as the following: right after the introduction comes up the evolvement of the land-collection process in China with the current compensation problems as its main part. Then the analysis of the advantages and disadvantages of the compensation mode in America, Germany, Korea and Japan followed by.Afterward it sums up various modes carried out in China as the long-term compensation modes of the land-collection in Hainan. Chongqing and Zhangqiu. Italso discusses the long-term compensation system theory focusing on the detailed means of structuring the long-term compensation system. Finally it introduces basic modes and related layouts of the long-term compensation system. Expatiating the legislation assurance of the long-term compensation, this thesis comes to an end.
