The Study Of Land Expropriation And Compensation In China's Urbanization

With high-speed development of economy accelerating the national urbanization, a large number of rural collective lands are requisitioned by Government to meet the needs of urban construction. Since the system for land expropriation and compensation was established in the era of a planned economy, which caused the range of expropriation somehow narrow and the standard of compensation not scientific. As the economic environment and its target were both such a great unrest that the system for land expropriation and compensation always found itself limited in practice - the efficiency of land's resources allocation was reduced, and for many lost-land farmers, their due rights were neither ensured protected - which as a result, certainly brought some negative effects to the social stability.Based on the existing literature and documents, this article is relying upon the guidance of property rights theory, land rent theory and public choice theory, beginning with defects occurring in the system for land expropriation and compensation, and finally analyzing why the current system would malfunction. At the meantime, by clearly pointing out the domestic situation of the system research for land requisition and compensation is right now lacking the model support, the writer is raising several very own experiments that all mean to improve the defective system including resorting to the support by foreign governments in terms of model supplement and even using a mathematical matrix to analyze the levels for land requisition and compensation, what's more, always taking the special situation of domestic property right and land market structure into delicate considerations. On this basis, the article is going to focus the following aspects of land expropriation - purpose, definition, ownership and farmers' rights maintenance - to at the end put forward the guidelines or suggestions to better the current land expropriation and compensation system.
