Market,apparently, is a place for exchanging commodities. But substantively, it is the summation of economic relationship in commodity exchange. The function of the land is to supply people with working condition, and places to work and survive. The land is used for its productions and services which are namely the intending profits of the land. And the intending profits are divided up among the authorities due to the abruption of the land right which is the essential to the land right. Different rights, due to their different connotations, are divided into different land profits.Social justice is both an important theoretical issue and a vital-real problem. With the speeding up of the urbanization and the development of cities in China, the population in cities is rising quickly and so is the requirements of land for residence, road, and virescence. On the other hand, owing to our limited amount of average land and the obvious lack of resource, the pressure is comparatively great on the supply of land. That causes the outstanding conflict between the lack and the requirements of land. At the same time, the researches on land are paid more attention. The government has actively searched for effective approaches and taken a series of administrative, economic, and legal steps to make logical use of land. Thus makes good improvement. From the point of view that setting up an open, fair and steady-going land market is the expectation of the government and the society, it is very important to improve the harmonious development of social economy by carrying out the policy of bid, auction and remising of land, which can enhance the efficiency of the market operation, improve the competitive environment, increase the financial income for the government and reduce the possibility of corruption during remising.This paper is divided into six parts besides the introduction which expatiates on the significance, the actuality, and the methods of this research. The first part is the theory which tells the correlative concepts and significations from the aspects of justice, equity, open, and common interests with the perspective of equity. The second part is the background which introduces the basic condition of land market in China and points out the maladies of former policies of land. The third part takes Changsha for example. It analyses the operation that the access of land in Changsha is openly sold to market in details based on the deep research in market set-up, development, and existent issues during the access of land in Changsha is openly sold to market. The fourth part evaluates policy. Based on the detailed demonstrations and guided by the theories on management, institutional economics and ethic, it expatiates on the significance of carrying out the policy of bid, auction and remising of land, and analyses the performance and the limitation of the policy. The fifth part ruminates over the policy. It concludes and researches the prevalent problems in the process of carrying out the policy of bid, auction and remising of land, analyses the relationship between the policy and the price of property, and uses the equity theory to inspect the justness of the policy. The last part gives some suggestions to the policy. Beginning with the market operation model, the government management, and the operation from administrative department, this paper puts forward four aspects and their relevant suggestions including land accumulation, land programming, performing of the contract, and the overseeing system.The characteristics and the innovations can be generalized as follows:Firstly, the theme, is not only original and realistic, but also a heated issue on the national economy and the people's livelihood. The most extant decisions of land use are made from the aspects of economy, technique, law, and politics, which seldom directly includes the aspect of ethical choice. Taking the change of land market system in Changsha for example, beginning with public management ethics and connecting with management, politics, and sociology for the first time, this paper has researched on the policy of bid, auction and remising of land from the perspective of equity theory in order to transfer the focus on the argument of the efficiency of the policy from making the policy to carry it out by administrative justice.Secondly, this paper has an instructional meaning for practice because of the arguments on the policy with the demonstrations. Based on the demonstrations, it has been researched with the methods of both theory and practice including cases, conversations, literatures from varies of perspectives such as administrative ethics, management, politics, sociology, institutional economics, and psychology and etc.Thirdly, all the materials are first-hand. The author investigated the whole process of bid, auction and remising of some particular lands in Changsha at a primary time and had conversations with administrative officers and personnel of Estate Company. This paper is analyzed in details by gathering, clearing up, concluding and epurating the first-hand materials.Fourthly, this paper gives some doable suggestions to carry out the policy such as to insure the performing of the contract of remising, letting people take part in the overseeing system, and etc.
