The labor market is an important constitute part of the modern market economy system .we should set up an unified and normalized labor market. It is the objective requirement of scientific development concept that stick to the people-oriented, and comprehensive, coordinated and sustainable development.It is an important foundation of building a socialist harmonious societyIt is needed to analyse deeply how to supervise and regulate the labor market so that we find out suitable methods to guarantee the norm and valid of the labor market and healthy development of the economy, politics, culture in our country.This text looked back firstly to the related theories and documentation about labor market. They mainly are:The standpoint of neoclassical economics.The decollate theory of labor market;Sieve theory;Social capital theory;The standpoint of neoclassical economics that set up on the assumption of the perfect Competition think surpose that the labor market is homogeneous. It extracts other non- market factors in the labor market and emphasizes the function of the market mechanism and market factor in the determination of wages level and the distribition of the labor force resources;The decollate theory of labor market that negate the premise assumption of the Perfect Competition of the neoclassical economics thinks that the factors of the system and society will decollate the labor market and the labor market is divided into two parts:main labor market and minor labor market;The sieve theory represented by Spence has discussed the structure of information and related phenomenon in the labor market, and clarify that as a kind of device, education is how to transmit signal and how to carry on adjust and balance between the wages and the signal of education in the labor market;Social capital theory represented by Mark Granovetter discussed the relation of human capital and reward by exot the "social capital" of the sociology under the angle of sociology and elaborate how the information disseminate through the social network in the labor market and how the feeling of interpersonal trust is set up ,consolidated and developed. In the meantime, this text looked back to the related research of labor market by some economists in the basis of formulating the foudamental assumption and related theorem of law and economics, for example,Phelps, Daron Acemoglu, R.Shimer.Then this text analyzed the Characters, problems and the depletion of supervisory in our labor market. As one of Production-factors markets, the labor market have general characters of production-factor market, namely market, openness and competitive, hierarchical and normal.But according to the transaction's particularity of labor market, the distribution of information is asymmetry between opportunities of employment and human resources and asymmetry of distribution master the labor market. The major problems in labor market are:(1) heavy and extraordinarily serious accident occur frequently;(2) internal contradictions, especially the contract disputes occur frequently;(3) supply and demand is unbalanced seriously;(4)The problems of decollate and discrimination of sex in the aspect of opportunities of employment is seriously. The depletion of supervisory in our labor market mainly body the following several aspects:(1)The operational mechanism of labor market is not enough sound;(2)The rules of labor market is not enough perfect(3) the means of legal execution are not perfect;(4) the consciousness of obeying law both employee and employer is not strong;(5) the level of Management is not high.In order to enable the problem analysis more meaningful,this text mainly analized deeply two problems,namely the default of labor contract and tort liability. Because of the asymmetry of information in the labor market, both the employer and employee always maximize their own one benefits in games.This text thinks the law shouldn't take the norm of intrest as the orientation and the law should solute the problem of right standard.Through the analysis of game both employer and employee, this text draw conclusions as follows.Before the"Draft law of labor contract"is promulgated, it is better not to sign a contract than to sign a contract for the employer.While after the"Draft law of labor contract"is promulgated, it is better to sign a contract than not to sign a contract for the employer.Aim at how to solve the problem of the contract default, this text surpose that it is ineffectiveness only depending the pure law to fill up sometimes.we should adopt the measures of the punitive compensation to protect the rights of observant party. It is necessary to adopt the measures of the punitive compensation.Then this text analysed the most superior remedies way of labor infringement under different information conditions. Under the perfect information condition,compensation is always the most superior remedies way because the sizes and orders of each variable both employer and employee are known by court. Under the imperfect information condition, although the sizes and orders of variable both employer and employee are not known by court,this text still draws the conclusion that compensation is the most superior remedies way. Whether what the circumstance of information is, the most superior remedies way of labor infringement superior is irrelevant to transaction cost.In the end, in order to safeguard the standard and effectiveness of the labor market and perfect the development of the labor market,this text put forward several policies and advices in view of existing problems in our labor market.Mainly as follows;(1) we should promote the construction of the secondary labor market through enlarging the on-the-job training education.(2)we should sound the system of market management law through strengthening to formulate law (3)we should strengthen the extent of enforcing law and improve the method of supervision and management;(4)we should raise the consciousness of obeying law both employee and employer and reduce the unbalance between supply and demand;(5)we should improve the level of modern management in our labor market.
