This houses with limited property rights analyzed in this paper have three main characteristics:First, houses with limited property rights have built in the rural land. Second, they are sold to non-farmers who are dwelled in city. Third, those buyers did not get the state-owned land-use right certificate and the property title certificate, only having the certificate of title of the houses with limited property rights promulgated by township government. In transition countries, it is usual to yield those property facts like houses with limited property rights, which are spontaneous evolution because of lacking institutional arrangements.The relative price changes, changes of the informal constraints in social,and the interactions between organizations promote the development of houses with limited property rights. In order to analyze the institutional causes about houses with limited property rights, this paper has focused on four aspects as follow:the inadequate supply of institution, intentions of institution design distorted, unrigged implementation of the rules, and institutional change of the lack of path independence. Right of the owner of rural land,right of the supervisor of rural land,and right of exploitation of people as well as the actually user of rural land have stuck in game for scrambling interests, because of the fuzzy property rights of houses with limited property rights.The analysis told us to deal with houses with limited property rights appropriately,the government agencies need speed large amount cost of information search, of exclusive supervision,of institution,of government regulation.The paper suggests:we should emphasis the benefits of right of the owner of rural land (such as the peasantry)and the actually user of rural land(such as the buys);we should complete and strengthen interrelated institutional arrangements, define clearly the property right of the houses with limited property rights. In all, step by step the houses with limited property rights are obtained legal status. The relation between the houses with limited property rights and rural land is the relation of the houses with limited property rights and rural land rights of construction land use.The paper suggest:land market and housing market should be united regardless of regional impede such as city or rural area.On persisting People-oriented,which is benefit to the sustainable development of the society, as well as the existence of priority, treat cautiously condition that we should clarity the legal status of "dim commercial residential building". Resolving property facts like the houses with limited property rights appropriately should be served as a juncture,necessary to propel timely the reform of land institution, housing system household registration system and a series of constraints which are the key reforms for narrowing the gap of dual structure, respecting the basic human rights such as migrate freedom,freedom of residence, which are favorable to the formation of a harmonious society.
