Research On The Governance Mechanisms Of Houses With Limited Property Rights

In the process of urbanization and housing commercialization in China, the spreadphenomenon of the houses with limited property rights (HLPR) has not been governedeffectively and caused extensive concern by the society from all walks of life. Theresults show that it is the main reason for poor governance effect which the governancemechanisms are not perfect. The governance mechanisms are analyzed based on thetheories of the governance and the public participation, and the results provide a basicway to solve the problem of the HLPR in China.Through the investigation of the market present situation and the regulation presentsituation of the HLPR, it is discovered that there are several noteworthy problems in theprocess of regulation of the HLPR. Specific performances in: that the control dominatedby the government ignores the interests of villages, buyers and other stakeholders;lacking of effective communication and consultation between government and privatestakeholders; that villages, buyers and other stakeholders are in a passive and weakstatus, and have weak consciousness and low degree of participation. The causes ofthese problems performance in: that the concrete operation standards and procedureswhich the governance of the HLPR should follow are not stipulated from the legal,which makes benefit expression mechanism lost of the villagers, buyers and otherstakeholders; lacking of governance ideas of the HLPR and unsound governancemechanisms of the information open, opinion feedback and communication andnegotiation; lacking of organization system providing security for realizing effectivegovernance.Governance mechanisms of the HLPR are put forward from the legal system, organization system, information open, communication, negotiation and feedbackmechanism by using the theories of the governance and the public participation againstthe main problems existing in governance of the HLPR. Some viewpoints are presentedsuch as the relevant legal system of the HLPR, the supervision and coordinationmechanism by the third party and the governance mechanisms of the information open,opinion feedback and communication and negotiation should be established andperfected, which are the basic guarantee to realize effective governance of the HLPR.The running mode and process of governance mechanisms of the HLPR are analyzed.The main work of each stage in the running process is described from the governancedraft stage, governance plan forming, completed and implementation stage andgovernance effect evaluation and summary stage.18general factors that hinder the formation and development of the governancemechanism of the HLPR are identified through text analysis and questionnaire survey.5key obstacle factors are extracted by using principal component analysis. Lacking ofcommunication and feedback mechanism and unclear governance responsibilitybetween government and private stakeholders is the primary factor that hinders theformation and development of the governance mechanism of the HLPR. Unclearattitude of government towards the HLPR, imperfect relevant law and policy system,lacking of the middle organization enhancing communication and consultation betweengovernment and private stakeholders and lacking of effective method and open andtransparent institutionalized procedures are other main factors that hinder the formationand development of the governance mechanism of the HLPR. According to these mainobstacle factors, some countermeasures and suggestions are put forward from perfectinglegislation and institutions related to governance mechanism, strengthening theconsciousness and the ability of public participation in governance, attachingimportance to the construction of governance organization, improving the governanceprocess and link.The application of the research results is helpful to promote the development ofgovernance theory and practice of the HLPR and clear the direction of the formationand development of the governance mechanism of the HLPR. It provides a basic way toachieve the effective governance of the HLPR.
