With the growth of global economy, global energy security problem emerged and environmental protection increasingly pressing on. It is imperative to seek for alternative energy which is more clean in China, and the biomass energy that is environmentally-friendly and renewable may be the best choice for us. This article is aimed at promoting the development of biomass energy industry, focused on the legal system of China, and some inspection and consummation are raised. This article can be mainly divided into five parts. The first part is mainly about the conceptual constructs related to the biomass energy, and values for the country to develop the biomass energy industry. The second part basically illustrates industrial development status and legal safeguard for biomass energy industry within China and abroad, and the deficiencies in the legal system for developing this recently emergent industry in China are elaborated. The third part is related to governmental finance-taxational incentive system, suggesting that tax of energy resource shall be taxed, and optimizing the allocation of social resources by tax measures. The fourth part involves marketing-motivational system. Based on the fixed-price systems and compulsory quota system, we should reduce the intensity of governmental macroscopic readjustment and control with increasing development of the biomass energy market, promote green certification trading system and green marketing concept. The last part is mainly concerning the legal enforcement and supervision. Specialized governmental agencies and intermediary organizations will be responsible for the supervision and control.
