Research On Perfection Of Supervision System Of Finance Leasing In China

Since the late 1980 s,China's finance leasing has gone through three important stages:development,consolidation and prosperity,along with the reform and development of the socialist market economy.At present,finance leasing,along with credit,securities,and insurance,is now one the most important tool of financial market resources allocation.At the end of 2016,China had 6158 financial lease companies in operation,with a contract balance of about rmb53,40 billion.In the 30 years' development of China's finance leasing industry,the construction of finance leasing regulatory system has been continuously improved with the exploration and practice of financial leasing industry.It has provided important institutional constraints and guarantees for its normative development and healthy development.This paper first generalizes the basic theory of supervision on finance leasing regulatory system in China,with a focus on the system's evolution and development.It analyses existing problems in finance leasing regulatory system and risks of business innovation.This paper found that the regulatory system of China's finance leasing has been continuously improved.At present,the "special chapter of the contract law" is adopted as the principle.The"operational explanation on the applicable legal issues in the trial of disputes over finance leasing contracts" is taken' as an important operational guide.Departmental and local regulations are main body of the finance leasing regulatory system structure.However,China does not issue a special law on finance leasing.In terms of supervision,China Bank Regulatory Committee and Commerce Department are playing their roles at the same time.The government regulation of heteronomy lack of uniform rules and lags behind in self-regulatory supervision.Taken the world over,has always been committed to eliminating the obstacles to the regulation of finance leasing.Financial leasing legislation provides a template for all countries,and is widely used for reference.Therefore,the fourth chapter of the paper conduct a comparative analysis on "the convention on the international finance leasing","lease rental demonstration" "law international accounting standards no.17-lease accounting","the accounting standards for international leasing-IFRS 16-leases" from the definition of the legal relation of the system construction,supervision mode nd how countries such as the United States,Britain,Japan,Germany and other countries carried out finance leasing regulatory system.At last,aiming at the problems in the regulations governing China's financial leasing and according to the experience of the international financing lease regulatory system construction,the paper puts forward for the policy Suggestions:the establishment and improvement of legislation system,supervision system,and so on.
