The Research On Harmonious Management Mechanism Of Technology Innovation And Patent Strategies In Enterprise

Nowadays we are in knowledge-based economy ages. The technology innovation and the patent strategy has already become the foundation and headsprings of the enterprise to survive, develop and create new competitive advantage. They are also the powerful weapons that assist the enterprise to win the vehemence competition both in local and international market, and furthermore to achieve the sustainable development of the enterprise. Depending on their strong technique advantage and abundant resource devotions, the enterprises in the developed country aggressively employ the patent strategy to protect the fruitful results obtained from the technology innovation at the time of carrying on the technology innovation. In the meanwhile, they implement the patent strategy to overlay every country that relates to their rights and interests, including China, in order to share the market and obtain huge economic benefits. Our country was affected by the traditional planned economy system for a long time and currently we are in a particular period that the planned economy system is being replaced by the market-oriented economy system. The patent system only exists in our country for a short period of time. The technique levels and innovation ability of many enterprises is still weak. A large mount of enterprises in our country overlook the protection and the usage of the intelligent property rights. In particular, they are not good at patent strategy implementation. Generally speaking, there are many problems about technology innovation of the enterprise in our country. The patent quality is low; patent implementation result is bad; the patent benefit runs off severely. In addition, there are certain issues about the patent management, such as weakness of patent strategy sense, lack of the patent strategy management and the technology innovation encouragement mechanism, shortage of the human resource and fund devotion. The existence of these problems is due to the inharmonious management of the technology innovation and patent strategy in the enterprise. The factors caused these problems are the imperfection of exterior guarantee environment and many internal system of the enterprise and therefore the technology innovation and patent strategy implementation cannot interact positively. Therefore, in order to adapt well to the intense domestic and international competition environment and deal with the impact on the intelligent property rights of the enterprise in our country which are caused by the enterprise in the developed country after China joined WTO, there is an urgent demand for those enterprises in our country to establish the harmonious management mechanism of technology innovation and patent strategy, so as to face the challenge and achieve the sustainable development. This study systematically analyzed the present conditions, existent problems and their reasons during the implementation process of patent strategy in the technology innovation of the enterprise in our country. Based on the successful experience of the transnational corporations and the enterprises in the developed country, through the comprehensive application of various methods, such as literature research, statistics analysis, data analysis, comparison analysis and instance analysis, the author proposes the strategy to establish the harmonious management of the technology innovation and patent strategy in the enterprises in our country. The purpose of this study is to find an effective management mechanism for the promotion of the technology innovation ability and the increasing of the independent patent quantity and in turn to provide guidance for the enterprise and government This thesis includes eight chapters. Chapter 1 describes the research background, present status and existent problems of domestic and international research on this topic. It also clarifies the research purpose and significance of this topic, the research methods used in the present study. Chapter 2 introduces the related concepts and theories involved in this research. More specifically, it explains the definitions and the characteristics of the enterprise technology innovation, the patent strategy and the harmonious management in detail. Chapter 3 elaborates the interaction between the patent strategy and every stage in the enterprise technology innovation process. Chapter 4 analyzes the present status of the technology innovation and patent strategy implementation of the enterprises in the developed country, especially the patent strategy in the translational corporations and the enterprises of United States, Japan, Korea, and its inspiration to the enterprises in our country. Chapter 5 analyzes the present status of the technology innovation and patent strategy implementation of the enterprises in our country. It mainly focuses on the achievement and existent problems in three aspects from technology innovation: patent application and grant, service intention-creation and non-service intention-creation and overseas patent application and grant. And it also analyzes the outside and internal factors that cause those problems. Chapter 6 proposes to establish the exterior guarantee condition and internal harmonious management system so as to implement the harmonious management of the technology innovation and patent strategy. The suggestion includes several aspects:constructing the exterior environment, increasing the enterprise fund devotion, strengthening the enterprise management work, reinforcing the business enterprise human resource construction, enhancing science and technology cooperation and communication and make use of the patent information resources. Thus, the enterprises can have a positive interaction between the technology innovation and patents strategy and therefore achieve sustainable development. Chapter 7 carries on an instance research, analyzing present status, existent problems and their reasons of the technology innovation and patents strategy in the motorcycle enterprises in Chongqing, China. In order to solve these problems, the author suggests to establish the exterior guarantee condition and internal management mechanism that promotes the harmonious management of the technology innovation and patent strategy in motorcycle enterprises. Chapter 8 is the conclusions and future directions of this research and hopefully it could be a useful reference and guidance for the following study.
