The Research On Supervision Strategy Of Copyright For Internet Audio-visual Programs Service Providers In China

With the rise of digitization and the Internet, internet audio-visual programs service industry has developed rapidly, and gradually becomes a mainstream trend. However, serious copyright violations have plagued this emerging industry with signs of intensifying, which not only violated the interests of copyright parties, making cultural and creative industries suffered huge losses, but will also contain the rapid growth of the audio-visual programs service industry, making the whole industry into a quagmire of copyright which can't carry out normal business activities. In order to protect the copyright of the internet audio-visual programs, relevant Chinese government departments have issued a series of laws against piracy and launched a number of special management actions, but relative to the mass piracy of information, these measures are not enough, so that people pay more attention to ISP who will be responsible for the task of network communication of audio-visual programs and hope to control the dissemination of information resources, through their checking copyright issues. Meanwhile, implement self-management mechanism in the network service providers industry to take the initiative to safeguard the interests of copyright owners, against piracy, ultimately advances the development of the entire industry healthy and orderly. Thus, the study on the supervision strategy of copyright for Internet Audio-visual programs service providers in China has important practical significance, and how to effectively monitor the copyright for ISP has become a focus of controversy. Firstly, the thesis starts with qualitative study of ISP copyright regulation, defines and sorts the related concepts, summarizes the major problems of copyright regulation for the internet service providers in China, and analyzes the crucial elements which have effected the copyright regulation of internet audio-visual programs from various aspects. On the one hand, from a legal perspective, sums up copyright-related regulatory policies and regulations for the ISP, simply explains the legal relationship of the internet audio-visual programs and analyzes copyright infringement liability for service providers; On the other hand, based on analysis of theoretical perspectives on foreign service providers and the Beijing Olympic Games'successful experience in copyright supervision, summarizes and analyzes the benefit references for ISP in China. In addition, on the view of empirical research, through the questionnaire, investigates the basic circumstances of the copyright supervision for ISP in China and learns the college users'views on the copyright supervision for ISP in China, summarizes the practical measures and experience of monitoring copyrights of Youku Corporation. Finally, based on previous studies, the thesis summarizes the elements which effect the copyright supervision of the internet audio-visual programs for ISP in China, and integrated with our own national conditions, draws lessons from the existing models, to build the consummated supervision model of the internet audio-visual programs'copyright for ISP, and then, the thesis offers 6 specific recommendations for ISP at the end.
