Without effective market supervision and regulation, the channel of information use and promulgation of private archives is obturated. Therefore, the management of personal archives are separated, isolated and out-of-order for a long time. That not only threatens the substantial security of private archives seriously, but also make against the realization of archival value and block the development of the national archives.With the establishing of the "social-cultural archives" view, people have known the value and effectiveness of private files in the science, history, culture, and so on. Along with the awareness of the social private right, it is necessary to change the status of China's private archives management, constitute early a concrete, Scientific and effective legal regulations to bring private archives into macro-management, and put into an orderly, standardized, legal administration track. At the same time, it is the necessary requirement of managing country and archives complying with laws. With the combination of theory and practice methods, this paper, through the comparison between domestic and foreign private archives management and the analyses on China existing legislation for private archives and its management system, focuses on how to solve the fundamental problems in the management of private archives and improve China private archives management, and explore the current lack of records management and its reasons from multiple perspectives. On this basis, combining with our national conditions and using foreign experience of legislation, institution constitution and private archives management, it pertinently brings forward the effective approach for China private archives management.First of all, we should improve the legislation of private archives. Archives legislation is the legal foundation of the national archives. With the private property acknowledged by the constitution, the state raises protection of private property to the height of the law. It is very exigent and necessary to strengthen the legislation for at the great background of constituting balanceable public right and private right. It is natural requirements for national strategy to implement the rule of law and socio-economic development and the main measures to accumulate and protect the national archives resources. Providing dependence and protection through legislation for the management of private archives, we can achieve that there are laws to go by and violation deserves punishment.Secondly, we should strengthen the supervision on private archives. The sociality of private archives provides justification and dependability for the state control. By strengthening the state control, private archives as one part of national information resources can be optimized and protected effectively, and provide service more effectively and conveniently for more users including the government itself.Thirdly, the paper advocates to establishing a diversified mode for private archives management. Researches by bringing private archives into national and social organization system help to change the status of isolated and out-of-order management and put private archives into an orbit of healthy development of standardization management and rational exploitation and utilization.In this management model, the author breaks the traditional perspective, and changes the researched on private files from the emphasis on practice management and case analysis operation to the height of the theoretical analysis. The paper gets rid of the traditional fragmented and the single research perspective and the construct the macroscopic management system.By the introducing four management main body, including owners of private archives. national archives management institutions, intermediaries and private archives management, it defines the responsibilities and status among the subjects of rights, and combines private archives management and official management organically to change the traditional chaotic pattern that the private files have been separately managed and their information are out of order.Finally, in order to facilitate public and give full play to the social value of private archives, the author makes a number of ways and measures, and emphasizes that we should properly handle the relationship between the use and confidentiality so that the opening and wide use of private archives and civic claims can achieve maximum harmony. That ensures that the whole lifecycle of private archives from the production, collection, and custody to development and utilization can be put into an orderly, standard management so as to achieve the purpose of improving management of private files.
