A Study On The Direction And The Path Of Regulation Reform In China's TV Media

The theme of this dissertation is about why and how to push the regulation reform of China's TV media. A better regulation reform should concentrate on three points: separating the public interest career and the commercial part of TV media ; changing some regulation idea to coordinate network convergence; rebuilding TV's public service. It is obvious that quasi-marketization and industrialization have been transforming TV stakeholders' role and their relationship. As a result, an economy regulation reform has had great political and social influence eventually.The goal on TV career is to satisfy people's ever-increasing spiritual and cultural needs, yet Chinese TV stations are not equal to fulfill this goal because they have to perform totally dissimilar functions: the mouthpiece of the Party function, public interest function and commercial function. This dissertation serves to remind the orientation of China's TV media regulation reform should include: separating the public interest career and the commercial part of TV media effectively; focusing on public service and supervision by the government while allowing market subjects to compete each other in an open and free maket.According to different excluisiveness and competitiveness , this dissertation argues that TV public service belongs to natural monopoly or public good which is forbidden commercialization. Based on the concept of property right in the discipline of law, the profitable business of TV media may include: TV programs except news reports, specialized channels which are adapt to Industrialization, paid channels excluded news channels, advertisement management, networks operations, and audio/video products. The separation between the public interest career and the business part have to resolve the property right problems, matched regulation reform and scientific procedure. After that, the government should control market access and market withdrawal according to the the capacity of our market.Regulation contains temporal technology characteristic in each period. Now the main idea of digital regulation is network convergence. So this dissertation pays more attention on degulation in market access which is an effective supplement for network convergence, and refers to the productivity and spreeding capacity of national information to handle the relationship between the opening and protection of culture industry.
