Study On The Social Effects Of Intellectual Property Rights Protection Of Information Resources

In nowadays world, intellectual property rights system has become an important basic legal system for every country in their course of promoting and safeguarding scientific and technological progress, economic growth and social progress. It means to protect private property but not aims at it, instead it aims at realizing the maximum of social benefits as a whole. Intellectual property rights system puts effective and full protection of intellectual property rights as the core, while at the meantime the latter's effects on stimulation, regulation, and safeguard mechanisms should also be at full play so that a balance between the intellectual property rights owner's individual interests and the whole society's interests can be obtained. The best reference system in viewing intellectual property rights protection is the social effects of it. But as the evaluation of these effects is concerned, different entities have different opinions and different standards, which reflect their distinctive interests and subjective desires. In this case, how to make objective evaluation in a scientific and systematic way has become an important subject worth researching. This thesis addresses mainly on this point and has made a relatively comprehensive exposition on the following aspects, namely the factors that influence the social effects of intellectual property rights protection, the principle s that should be followed, current situation, achievements, existing problems and proposals and countermeasures, etc.This thesis stresses on the equilibrium principles that should be followed in intellectual property rights protection. And it also sums up five aspects that should be handled in a balanced way: the production, spread and utilization of knowledge; law-making and execution of it; international rules and national interests; the enterprises economic returns and social responsibility; the rights of producers and consumers. Then it summarizes five different forms of the social effects of intellectual property rights protection as follows: the enthusiasm of the enterprises in intellectual property rights protection; level of prosperity of the works; the periodic changes in applications and approval of patents and trademarks; the influence on education and the spread of public information. Then the thesis gives a brief account of the current situation of intellectual property rights protection in China in a systematic and comprehensive way. It affirms the achievements gained thus far and provides proposals and countermeasures for the existing problems in information resources and intellectual property rights protection atthe end of the essay. That is, for instance, to establish intellectual property rights protection system suitable to our country's development stage; to draw up and carry out national strategy of intellectual property rights; to set up coordinating mechanism; to further improve administrative system of intellectual property rights; to give full play to industry association; to formulate anti-monopoly laws that is correspondent both at home and abroad; to increase government input in intellectual property rights protection and to carry out publicity education of intellectual property rights, etc. This thesis's theoretical contributes are the following: it put forward the evaluation system of the social effects of intellectual property rights in a systematic and comprehensive way thus provides reference for the improvement and development of our country's intellectual property rights protection system.
