Legislation On Farm Animal Welfare In China

With the promotion of animal welfare concept and the transformation of consumer consciousness, the farm animal welfare condition was drew more and more attention gradually. Many countries had already made the more perfect farm animal welfare law. Many International organizations have also paid greater attention on animal the welfare and enacted international general standard, the criterion and the suggestion. On the sharp contrast, China's animal husbandry farm animal welfare with a late start, have imperfection on many aspects. In particular, China still have no relevant laws and regulations in facing the fact that animal welfare is likely to become a new reality of trade barriers with China's accession to the WTO. This paper is designed to explore China's present theory and existing problems in the practice area of farm animal welfare. A useful and feasible way will be found out by learning advanced foreign legislative experience and setting up farm animal welfare legislation in China to promote farm animal welfare laws soon to carry out, and to achieve the purposes of the harmonization of modern social and economic benefits, ecological and social benefits.First of all, this paper will extend the farm welfare animal theme from the meaning of animal welfare, and make an exposition on the connotation of farm animal and farm animal welfare. It is found that China currently has no specific farm animal welfare legislation, and there are many problems in relevant laws and regulations by looking though the relevant law. Such as: the number of China's existing animal protection laws and regulations is small, which can not form a complete system; the legislative goal is backward, lacking the concept of animal welfare; laws and regulations stipulation is large while coverage is small, operation is poor; legal liability is not strict; supervision system and mechanisms are not smooth and so on. Because of this, people are anxious about the farm animal welfare conditions, the animal water injection problems, the seriousness of animal epidemic disease situation, and the slaughtering ways, so many brutal treatments on farm animal is everywhere. Therefore, this paper explains that it is high time to enact farm welfare laws though the discussion of animal welfare legislation's necessity and feasibility in China. In last part of this article, it made some suggestion about legislation. We can revise the laws first, and then make a preliminary concept of animal welfare legislation in a proper time. Finally, it makes a preliminary concept of animal welfare legislation. From aspects of the legislative model, the legislative goal, the basic system, legal liability and supervision mechanism, it puts forward its own design and expresses the expectation on China farm animal Welfare legislation bright future.
