| Animal welfare legislation have a history of several hundred years abroad, while has just started in our country. Under the concerns and advocating of a lot of scholars and medias, animal welfare is outstanding day by day, but most suggestions concentrate on promoting legislation, or explain on the necessity that legislating, but mention seldom where it will be system environment that legislate, and this is exactly on the range that sociology of law study. This text thinks that it's necessary to research its foundation of institutionalizing when carrying on a series of institutional improvement of legislating etc. to the farm animal welfare in our country. This foundation includes four parts: the goal choice for institutionalized farm animal welfare; current situation of farm animal welfare in our country; the reasons why peoples haven't accept farm animal welfare; the compatibility of idea, system and reality with farm animal welfare institution. Through from the link of raising, transport link, butcher link and new phenomenon that appear recently, it describes farm animal current situation in our country, and proves that the treatment to farm animal welfare remains to be improving. Because animal welfare is always mentioned in the same breath with people's welfare level, it's necessary to analysis the obstacle of cognition that farm animal welfare haven't be accepted and needed. Traditional culture and ideology, modern consumption idea such as pursuit to health and security food, pollution-free food show its possibility that measures to treat animal kindly issue constantly, then within existing economic level and legal system frame, we can see outlet that farm animal welfare is institutionalized. The fair principle of the system to the institutionalized goal should be adopted, and certain animal welfare measure is administrated under guaranteeing interests of majority.
