Research On The Property Declaration System

As an important measure to prevent corruption, the property declaration system of civil servant is an effective measure to promote honesty and prevent corruption. Until now, the property declaration has been built up all over the world and become the universally recognized system of anti-corruption, known as "Sunshine Act." Public servants'property declaration system requires that a certain range of national public officers declare their property and related persons'property to appointed agencies to accept public supervision and to assume corresponding legal liability. Under the property declaration system, civil servants are required to declare their property and make their property public by law. By protecting the public's right to know so as to execute the monitor right of citizens, the property declaration system has achieved the institutional arrangements to restrict the power. The property declaration system reflects the rule of law which controls and regulates the power. In addition, the property declaration system is also an inherent professional requirement of the public servants. With the inherent public oversight, anti- corruption and other functions, the property declaration system has significant impact on the prevention of corruption and the establishment of an efficient government. Therefore, to promote the legislation of the property declaration system and to set up the property declaration system of our Public servants totally correspond with the changing trend of anti-corruption from treating the symptoms to fundamentals.Firstly, in this paper, we will explore theoretical and real foundation for the establishment of the property declaration. Secondly, through researching and comparing related national or regional property declaration, we will focus on analysis of experience and lessons from the system practice in China. Thirdly, we will explore the route and measures to set up the property declaration system in China. I hope that I can supply some specific, methodological, operable advice.This paper consists of five parts. Part I mainly present the origin, conception and content of the property declaration system. Moreover, the major character of the property declaration system will be analyzed; In part II, two main lines, legal principle base and reality base, will be employed to explore the theoretical foundation to set up the property declaration system all over the world; In part III, we will summarize and compare the basic content of the property declaration systems in other countries to get some inspiration for our system construction; In part IV, we will sort out and analyze the problems and reasons in the construction of the property declaration system in China; In part V, based on the necessity and feasibility studies of the property declaration system in China, we will explore how to construct and improve the property declaration system of Public servants in China.
